Bus rider charged in bomb threat

AUSTIN (KXAN) – A 40-year-old Austin man was jailed over the weekend after passengers on a Capital Metro bus said he yelled, “Get off my bus. I have a bomb.”

Luis Garcia, who was riding on downtown bus around 12:30 p.m. Saturday when the threat was made, according to an arrest warrant affidavit released Monday. The documents said the threat was made during a stop. Several passengers confronted Garcia and the driver ordered him off the bus.

Meanwhile, a witness called 911 and said Garcia boarded another bus. A police officer caught up with the second bus and pulled it over, the affidavit said. The officer boarded the bus and found Garcia, based on a description provided by the witness.

According to the affidavit, Garcia said he was kidding about having explosives in his backpack and acknowledged that it was unwise to make such a remark on a bus filled with 20-30 passengers.

There was no bomb when the officer searched the backpack. But Garcia was charged with making a terroristic threat, which is a third-degree felony that carries a prison sentence ranging from two to 10 years and a fine of up to $10,000.
